Terms of Use
These terms are an agreement between you and De Beers Labs ("we", "us") covering the TrailGuard apps and service.
By using TrailGuard you accept these terms. If you do not accept them, do not use the app.
1. Who can use TrailGuard
You must be 13 or older to have your own account. Children under 13 can take part only through a supervised account created by an adult in their household, with that adult's recorded consent — see section 7 of the Privacy Policy.
You are responsible for what happens on your account, and for keeping your sign-in details to yourself.
2. What we ask of you
TrailGuard is a place for people who walk dogs. Use it that way.
You must not:
- post or send anything abusive, harassing, threatening, hateful, or sexually explicit;
- post anything that isn't yours to post, or that breaks the law;
- impersonate somebody else;
- use the app to stalk, follow, or intimidate a person — including through the safety beacon, live locations, or shared routes;
- upload photographs of other people without their agreement;
- scrape, disassemble, or hammer the service; or
- use TrailGuard for anything commercial without asking us first.
There is no tolerance for objectionable content or for abusive behaviour toward other people. This is not a formality — it is the rule the rest of this section exists to enforce.
3. What you post stays yours
You keep ownership of your photos, posts, messages and walks.
To run the service, you give us permission to store your content and to show it to the people you have chosen to show it to — your friends, your household, or a loop you have joined. That permission ends when you delete the content or your account, except where somebody else already holds a copy (a message you sent sits in the recipient's conversation, as an email would).
We do not use your content to advertise, and we do not sell it.
4. Reporting, and what we will do about it
Every post, comment, message, person and loop can be reported from inside the app, and you can block anyone. Blocked people are listed in Settings, and blocking can be undone.
When something is reported, we will review it and act within 24 hours. We may remove content, or suspend or remove an account, when these terms are broken. Where we can, we will tell the person why.
5. Safety — read this part
TrailGuard is not an emergency service.
The safety beacon shares your live location with a person you choose. It depends on your phone having signal, battery, and permission to use your location. It can fail for any of those reasons, and it does not call anyone for help.
Do not rely on TrailGuard as your only safety measure when walking alone. If you are in danger, call 000.
Route suggestions are generated from paths other people have walked, and from public map data. We do not inspect them. A route may cross private land, a busy road, or something unsafe for a dog. Use your judgement — the responsibility for where you walk is yours.
Hazard reports are posted by other walkers. We do not verify them. They may be wrong, out of date, or missing.
6. TrailGuard Plus
During the beta, every feature is available to everyone and nothing is charged. The Plus screen shows what a future subscription is intended to include; it is not a purchase, and no payment is taken.
When Plus does launch, subscriptions will be billed through the App Store or Google Play, will renew automatically until cancelled, and can be cancelled in your Apple or Google account settings. Refunds are handled by Apple and Google under their own policies. We will publish the price and terms before charging anybody, and nobody will be charged without agreeing to them first.
7. The beta
TrailGuard is in testing. It will have bugs. Features will change or disappear. Data may be lost. Do not use TrailGuard as the only record of anything you would be sorry to lose.
8. Ending it
You can stop using TrailGuard whenever you like, and delete your account from Settings → Account → Delete account.
We may suspend or close an account that breaks these terms, or where we have to for legal reasons. If we close the service down, we will give you reasonable notice and a chance to get your data out.
9. What we do and do not promise
We provide TrailGuard as it is. We work to keep it running and correct, but we do not promise it will be uninterrupted, error-free, or that route suggestions and hazard reports will be accurate.
Nothing in these terms limits rights you have under the Australian Consumer Law, which cannot be excluded. Where the law allows us to limit our liability, we do — to resupplying the service or paying the cost of doing so.
10. Changes
We may update these terms. If a change matters, we will tell you in the app before it takes effect. Continuing to use TrailGuard after that means you accept the new terms.
11. Governing law
These terms are governed by the law of Western Australia, and the courts of Western Australia and the Commonwealth of Australia have jurisdiction.
